Kläger: (2) Witwe des Jacob von der Fehr zu Wismar
Beklagter: Bürgermeister und Rat zu Wismar
Fallbeschreibung: Fehr hat 1705 ein Haus am Markt gekauft und dafür 400 Rtlr vom Waisenhaus geliehen. Dieses Geld wollte er durch den Verkauf seines Hauses auf dem Schilde abbezahlen. Da der Käufer jedoch nicht bezahlt, gerät Fehr selbst mit seinen Zinsen in Rückstand und wird mit Vollstreckung bedroht. Kl.in bietet dem Rat zunächst die Zahlung von 50 Rtlr Kapital und 42 Rtlr Zinsen an, die dieser jedoch ablehnt und auf der Absicherung durch Stadtbuchschriften in anderen Häusern sowie Zahlung von 100 Rtlr Zinsen besteht und sie widrigenfalls mit Zwangsversteigerung des Hauses bedroht. Dagegen appelliert Kl.in an das Tribunal, dessen Antwort jedoch nicht überliefert ist.
