Die Beklagten hatten offenbar vorgeschlagen, dass die Schuld mit Pensionserträgen für das Gut, die aus einer Kapitalverschreibung von 50 Rtlr noch aus der Zeit vor der Verhypothekisierung an Heymans herrührten, verrechnet werden sollte. Das lässt Heymans nicht gelten. Er habe niemals das Gut wirklich in Besitz gehabt, sondern es sei weiter von den Schuldnern bewohnt worden. Er habe jedoch an dem in seinem Obligationsvertrag vereinbarten Zahlungstermin nicht mehr als 8 Rtlr erhalten.
