Enthält: Der Besitzer des Brucker (Bruggener) Hofs in Mödrath, der Regens des Dreikönigengymnasiums in Köln Joseph Hartzheim, beschwert sich, dass das Stiftskapitel, namentlich dessen Kellner Kanonikus von Cöllen, einen halben Morgen Land hinter der Kirche in Mödrath, der zum Brucker Hof gehört, als Teil von 10 Morgen Stiftsländereien beansprucht, das Land durch einen Landmesser abmessen und durch Entfernung der alten Grenzsteine und Pfähle und Setzen eigener in Besitz genommen hat. Er fordert die Aufhebung dieser widerrechtlichen Tat und Restitution des Lands. Amtmann von Hersel befiehlt dem Kerpener Gericht die Wiederherstellung des alten Besitzstands, und dass der Besitzer darin nicht behindert oder beeinträchtigt werden soll. Er setzt jedoch eine Frist von acht Tagen, wenn sich andere Rechts- oder Beweislage ergebe, darüber Bericht zu erstatten, um neues Recht zu erkennen. Herr von Cöllen lehnt diesen Beschluss natürlich ab - offensichtlich ohne Erfolg. Daher fordert er seitens des Stiftskapitels wenigstens eine Ermäßigung der Vermessungs- und Gerichtskosten, die ihm zugestanden wird.
