Schulden an das Stift St. Martin, Pfändung für den Pachtherrn
Enthält: Der Scholaster den Stifts St. Martinus in Kerpen, Kleinermann, klagt offene Forderungen an Sebastian Becker ein. Trotz eines Berichtsbeschlusses schon von 1689 und eines bald darauf getroffenen Vergleichs hatte Becker bisher nicht gezahlt, und die Schuld war noch mehr gewachsen. Gleichwohl zeigte er sich unwillig, "sich in Rechnung in(zu)lassen". Kleinermann bittet daher, die Winter- und Sommerfrüchte des Beklagten, die auf dem Land, das dem Kapitel gehört, liegen, zu beschlagnahmen ("prohibitionem ... zu erkennen") und ihm die Einscheuerung als Drittem ("ad locum 3tium") zuzugestehen, zumal er, Kleinermann dafür als Bürge einstehe. Dem Beklagten soll unter Androhung eines Säumnisurteils ein Zahlungstermin bestimmt werden. Außerdem soll bei Nichteinhaltung, die Rechnung des Klägers einseitig vom Gericht ex officio angenommen werden und gelten (d. h. der Beklagte hätte dann keine Möglichkeit mehr zu Entgegnung). Als Sebastian Becker 1696 stirbt, ist er dem Stift und den Stiftsvikaren Rasquin und Putz immer noch Geld und anderes (Mobilien, Immobilien und Naturalien) schuldig. Der Anwalt des Stifts fordert das Gericht auf, weil die Einkünfte ("invecta et illata") eines Ackerguts stillschweigend dem Pachtherrn als Pfand gehörten, alle Früchte, das Vieh und die Mobilien Sebastian Beckers zu pfänden und mit dem Verbot, sie zu veräußern, an wen auch immer, zu belegen und ein Inventar davon anfertigen zu lassen.
