Enthält: Die Erben Heinrich (Henrich) Ivens verwahren sich gegen das Ansinnen ihrer Gegner, die damit "dießeitige nahe Freundtschafft durch einen unbesonnenen Prozeß zu zertrennen" drohen, sie zur Räumung ihres Teils eines Hauses und Bauplatzes in Mödrath zu bewegen bzw. sich mit ihnen auf Herausgabe zu vergleichen ("ad edendum titulum zu convenyren"). Sie berufen sich darauf, dass sie schon beim Tod ihres Vaters, also 30 oder 40 Jahre lang, in Besitz des Hauses gewesen sind und deshalb auch weiterhin darin zu bestätigen ("manuteniren") seien. Sie begründen das mit den Rechten, wonach dem realen Besitzer der Vorzug vor den nur Besitzanspruch erwoben habenden Erben oder Nachfolgern, zumal gegen den Verstorbenen oder Vorbesitzer, zu gewähren sei ("quod possessori detur manutenentia contra haeredes et succesores ex sola possessione acquisita contra defunctum vel antecessorem"). Einen Vergleich über Herausgabe lehnen sie daher als unzeitig ab ("noch zur Zeit zu unfeilen Marck gebracht").
