a. Testamentarische Verfügungen konnten nach lübischem Recht nur über wohlgewonnenes, nicht Erbgut getroffen werden. Der Testator musste vor allem geistig gesund sein. Vorgeschrieben waren die Ausfertigung auf Pergament und die Gegenwart zweier Ratsherren als Zeugen, die je eine der insgesamt drei, oft in Form von Kerbschnitturkunden verfassten Ausfertigungen erhielten und beim Tod des Erblassers vor den Rat brachten.
b. Die ältesten Testamente, noch im 19. Jh. gerollt aufbewahrt, befanden sich, nach Angabe von Wehrmann 1892 "seit jeher im Archiv", die späteren bis 1866 wurden beim Oberstadtbuch bewahrt und gelangten (wohl infolge der neuen Gerichtsorganisation von 1864) ins Archiv. Die Reichsjustizgesetze von 1879 übertrugen die Zuständigkeit in Nachlassangelegenheiten dem Amtsgericht Lübeck (vgl. dort). Die Formierung der Testamente bis 1800 zu einem Bestand beruht auf keiner administrativen Grundlage, sondern erfasst die von Auslagerung und Rückführung betroffenen Stücke; nicht zurückgekehrt sind vor allem die Stücke des Zeitraums 1408-1412.
