Der Kläger behauptet, vom Beklagten vor seinem Hause misshandelt worden zu sein. Der Beklagte behauptet, ein Reiter habe mit seinem Gesellen wegen falschen Beschlagens seines Pferdes Streit bekommen; der Reiter hat seine Frau misshandelt und ihn bedroht. Es sei Hilfe von der Wache am Ludgeritor geholt worden, der Kläger habe die Partei des Reiters ergriffen und sei nun von den Soldaten der Wache vom Pferde gerissen und verletzt worden. Durch die Richtherren werden als Zeugen vernommen: 1. Johan Alhard von Donstorpff, 27 J. alt; 2. Reiter Dietrich Uphaus, 25 J. alt; 3. Leutnant Johan Herding, 25 Jahre alt; 4. Hauptmann Franz Werner, 35 J. alt; 5. Wirtssohn Henrich Lüttighaus auf der Königstraße, 23 J. alt; 6. die Brüder Johan Berning und Ratsherr Henrich Berning. Durch den Regimentsschultheiß Henrich Wibbeke werden folgende unter Hauptmann Johan von Niedeggen stehende Soldaten vernommen: Christoffer Maibohm, Johan Wesselers, Johan Lohman und Johan von Oelde aus Telgte. Erwähnt werden Statius Rüsche, Knecht des Beklagten; die Soldaten Steffen Bredenstein, Steffen Heitbömer und Bernard Waterman.
