Enthält: Der Anwalt des Beklagten und Nachklägers Horn nimmt als bekannt an, dass der Kläger und Nachbeklagte Reutter die Teilung, um die es geht, zwar grundsätzlich anerkannt habe, was er darauf geantwortet, hält Horn jedoch für unwahr. Den vom Gericht in der vorigen Sitzung am 4.11.[1616] auferlegten Gegenbeweis, in dem er die vom Beklagten vorgelegte Original-Teilungsurkunde bestätigen und ablehnen sollte ("agnoscendo vel diffitendo"), hatte der Kläger aber nicht erbracht. Der Beklagte bittet daher das Gericht, die Teilungsurkunde wegen des öffentlichen Ungehorsams des Klägers als bekannt (d. h. wie wenn er sie gebilligt hätte) anzunehmen oder ihm, unter Übernahme der dabei entstehenden Kosten, nochmals eine Frist zur Stellungnahme einzuräumen.
