Enthält: Johann Leonardts klagt, dass sein Bruder Michael gegen Gesetz und Landesbrauch seinen Anteil am an sich unteilbaren elterlichen Haus zum Schaden und Verderben der anderen Hälfte an seinen Nachbarn Niclas Wirtz gegen einen halben Morgen Land für 31 Rtlr plus 2 Rtlr für Unkosten und 30 Rtlr an barem Geld, insgesamt also 63 Rtlr, eingetauscht und mit dem Käufer vereinbart hatte, ihm, Johann den Retrakt (d. h. den Rückkauf kraft Näherrecht) zu verwehren. Der Geschädigte kämpft nun vor Gericht darum, dennoch das Rückkaufrecht zu erhalten. Das Problem dabei ist, dass die Landesordnung, Kap. 98 und 99, die er anführt, im Wortlaut ein "Beschuddrecht" nur für einen Kauf/Verkauf vorsehen. Im vorliegenden Fall handelt es sich aber um einen Gütertausch mit zusätzlicher Geldzahlung. Johann Leonardts argumentiert, dass damit zumindest teilweise ein Kauf getätigt wurde, also auch das Retraktrecht angewendet werden dürfe. Zum Beweis führt er das Beispiel des Falles Mattheiß Wolff gegen Caspar von Essen am Stadtgericht von Bergheim an. Dort hatten Schultheiß und Schöffen gegen von Essen als den Antauscher Retrakt zugelassen, da er das Tauschobjekt von Cörtgens Haus und Hof zur Hälfte mit Geld und zur Hälfte mit Waren bezahlt hatte. Darüber hinaus beruft er sich auf das Verbot der "Versplissung" (d. h. der Teilung von Gütern, zumal wenn es abhängige Güter sind). Ob Johann Leonardts Recht erhielt und Niclas Wirtzs das Haus räumen musste, ist nicht überliefert.
