Der Appellat wendet gegen seine Ladung an das RKG ein, daß er an der Vorinstanz keine Partei gewesen ist. Das RKG weist mit Urteil vom 28. Mai 1561 die Appellation ab und verweist die Sache an die Vorinstanz zurück.
